ORDER
Mrs.Mythreya Chandru, learned Special Government Pleader, takes notice for the respondents.
2. The learned counsel for the petitioner would submit that the petitioner is working as a Primary School Headmaster in Arthanari Aided Primary School, which is an aided School receiving teaching grant from the Government of Tamil Nadu. It is stated that the petitioner moved to Selection Grade on 30.06.2025 and his pay was revised notionally from 01.01.2006 and with monetary benefits with effect from 01.01.2011 vide proceedings of the Management dated 09.07.2012. It is further submitted that the aforesaid proceedings was approved by the 5th respondent on 10.09.2012 as per the Government letter dated 08.11.2010, G.O.Ms.No.23 dated 12.01.2011 and Government Letter dated 05.01.2012.

While so, after a lapse of 14 years of pay fixation, the 5th respondent issued proceeding for re-fixation and recovery vide order dated 23.10.2025, on the ground that the Government vide letter dated 15.12.2023 states that the Selection Grade Scale of Pay of Primary School Head Master has to be restricted to the Ordinary Grade Scale of Pay of Middle School Headmaster.

It is the case of the learned counsel for the petitioner that the benefit already given cannot be taken away from the petitioner and the letter dated 15.12.2023 cannot be given retrospective effect. Challenging the order of re-fixation and recovery dated 23.10.2025, the petitioner has filed the writ petition.
5. In view of the above, there shall be an order of interim stay in respect of recovery alone.
6. Registry is directed to post the matter on 20.01.2026 along with
W.P. No.47863 of 2025.
